Perpetuating Anti-Muslim Discrimination through the Interpretation of Religious Equality in the European Court of Human Rights

AbstractFaced with widespread prejudice and discrimination, European Muslims are increasingly resorting to the European Court of Human Rights as a last-ditch strategy to transform state policies toward minority faiths. While the Court has a mandate to protect religious freedom and equality, the conservative and sometimes biased way in which it has interpreted these concepts has enabled the persistence of stark asymmetries in the legal and social statuses of different religions. Using an analysis of relevant cases, this article seeks to highlight the judicial processes that currently sustain Muslim subordination and pinpoint specific reforms that could reverse the trend.

In Italy, the secrecy of confession practised in some religious denominations and especially in the [Roman] Catholic Church, is widely recognised. Zdaniem autora przypadek ten dobrze ilustruje realia, w jakich przyszło żyć duchowieństwu w Polskiej Rzeczypospolitej Ludowej. Wojciech Kloc, ze Zgromadzenia Braci Albertynów, prowadził handel dewocjonaliami w celu zarobienia pieniędzy na remont dachu domu zakonnego. AbstractThe increase in religion-related conflicts around the world emphasizes the urgent need for a better understanding of the role of religion and religious freedom on socio-economic development, both theoretically and empirically. The essay reviews the issue of the legal relevance of religious identity, and of its possible scope, from the standpoint of the values that underpin contemporary constitutional States (equality, liberty, dignity, secularism). The essay will try to show that, in the light of the aforementioned values, religious identity has in fact legal and constitutional relevance. This does not imply, however, that legal claims based on religious identity should receive absolute legal protection - rather, they are bound to be consistently balanced against other constitutionally relevant rights and interests.
